When completing purchases by clicking the “Finalize Purchase” button on SRGFX.com you agree to the terms of the SRGFX Terms and Conditions. This is a contract agreement between you and SRGFX. Please note that this is a license to use SRGFX graphics packs, not an agreement of ownership. If you do not agree to the terms, you are not permitted to use SRGFX stock artwork.

Layout templates may not be used for mass production products such as posters, hero prints, or business branding. Layout templates can be used on T-Shirts under the restriction of an agreed limited run between SRGFX and client. Layout templates can be used for wrap proofing and portfolio display work. Any works with an SRGFX template related to a direct profit must be agreed upon with the represeting party at SRGFX and the license holder of the layout template.

Permitted Copies

You may not duplicate or copy SRGFX Graphic files except as needed to use it as expressly permitted by this Agreement. However, you may make one (1) copy of SRGFX Vector Graphic files for backups. All permitted copies must maintain the exact copyright, trademark and other proprietary notices that appear on and/or in the graphic files artwork including all documentation.

Online Sales of Wraps and Promotional Materials

You may use SRGFX graphics to sell physical wraps and promo materials in an eCommerce platform. To sell physical wraps that include SRGFX designs requires the following.

1. A contractual agreement of online physical sales with SRGFX.
2. Written consent from SRGFX approving of eCommerce platform and appearance.
3. The SRGFX copyright must be included with each design containing any SRGFX graphics. All SRGFX digital files have a full copyright by SRGFX and must not be claimed otherwise.

Resale of any digital SRGFX files is prohibited.

Courses and Lessons

SRGFX courses are to be viewed by the sole owner of the SRGFX.com Account. Courses and lessons are not to be shared, redistributed or collaboratively purchased, joint purchases will result in loss of account with no refund.

Courses are not to be used to educate multiple staff members or employees. Courses are to be purchased for the sole owner of the account and for the sole owner only. Each staff member must acquire their own personal SRGFX.com account.

Discount extended licenses are available for multiple course purchases. Each user who purchases a course will have their IP address recorded and monitored.

Excessive video plays and multiple IP address traced to one account will result in loss of account and the right to use all SRGFX products.

Intellectual Property Rights

You acknowledge and agree that SRGFX Vector Artwork and permitted copies, and the trademarks associated with SRGFX, are the intellectual property owned by SRGFX. SRGFX graphics and artwork is protected by copyright including without limitation, by United States Copyright Law, international treaty provisions, and applicable laws in the jurisdiction of use.

You may not copy SRGFX graphics and artwork except as provided under the “Permitted Copies” provision above.

License Transfer; Service Bureaus

You may not rent, lease, sublicense, distribute, lend nor transfer SRGFX graphic files or any copy or portion of SRGFX Artwork, without SRGFX prior written consent.

No Other Use

You are granted only the rights expressly stated in this Agreement, and you may not use SRGFX graphics or artwork for any other use. Without limitation, below are examples of uses that are NOT permitted under this Agreement and require purchase of a separate license from SRGFX:

1. You may not share SRGFX graphic files with any other business.
2. You may not use SRGFX graphic files at more than one physical location
3. You may not use SRGFX products on two separate computers at the same time. A second purchase is required for a second work station.
4. You may not change the name of SRGFX graphic files
5. You may not resell or redistribute SRGFX graphic files
6. You may not resell the rights to use or the SRGFX graphic files or any graphic files that contain SRGFX graphics.
7. You may not sell the rights to use or the SRGFX graphic file in the event or selling your company.

Disclaimer; No Refunds

All purchases of SRGFX Graphics and Artwork are final. In no event will a refund be issued for any items on the SRGFX.com website. The user is responsible to know which files he or she has or has not purchased. Refunds will not be given for double purchases.

Damages; Limitations

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL SRGFX BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE SRGFX GRAPHICS AND ARTWORK, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF SRGFX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

Disputes

Any dispute or claim arising from or relating to this Agreement or SRGFX is subject to binding arbitration in Greene County, Missouri, under Missouri law.  You agree to those terms by using the graphics and materials.

Governing Law

This Agreement represents the entire agreement between you and SRGFX in connection with its subject matter. This Agreement supersedes any other “SRGFX Terms and Conditions” which may be included with SRGFX Artwork or previously displayed on this website, and/or any prior agreements between you and SRGFX in connection with its subject matter. This Agreement may only be modified by SRGFX.
